Public Sector Unions Make Government Unaccountable to the Will of the People

(p. A17) In 2008, six years after securing control over New York City’s public schools, Mayor Michael Bloomberg and schools chancellor Joel Klein put forward a program to tie teacher tenure to student performance. The goal was to reward the best-performing teachers with job security, encourage better student outcomes, and hold teachers accountable for demonstrated results. To most New York residents, it surely sounded like a good idea.

To New York’s teachers’ unions, however, the program was utterly unacceptable. Union leaders lobbied Albany, threatened state lawmakers (who could pass legislation binding the mayor) with the loss of political support, and walked away with a two-year statewide prohibition on the use of student test performance in tenure evaluations. In short, the union thwarted the mayor’s authority over the city’s schools and commandeered the state’s legislative power.

In this case and many others, a public-sector union served its own interests at the expense of the public’s. In “Not Accountable,” Philip Howard shows in vivid detail how such practices have made government at all levels unmanageable, inefficient and opposed to the common good. He argues that, in fact, public unions—that is, unions whose members work for the government—are forbidden by the Constitution. The argument, he notes, would have been familiar to President Franklin Roosevelt and George Meany, the longtime president of the AFL-CIO, both of whom championed private-sector labor but believed that public workers—teachers, fire fighters, policemen, civil-service employees—had no right to bargain collectively with the government.

Mr. Howard makes a persuasive case, but the chances of seeing it affect American political life are, at the moment, remote.

Still, the goal is admirable and worth pursuing. In place of public-sector collective bargaining, Mr. Howard calls for a merit-based system for hiring and evaluating government employees. Instead of stultifying work rules that thwart creativity, he envisions a public-sector structure in which employees can use their talents and judgment to improve the functioning of government. Fundamentally, Mr. Howard views the Constitution, and the law generally, as a mechanism for both action and accountability, one that entrusts powers to inevitably fallible human beings while subjecting them to the checks of others in authority and, ultimately, to the will of the people.

Tim Cook’s Apple Is Silent on Communist China’s Suppression of Human Rights

(p. A19) Apple CEO Tim Cook has been taking a beating over his company’s coziness with Beijing. It comes amid protests across China against the government’s strict Covid-19 lockdowns, including at a factory in Zhengzhou where most of the world’s iPhones are made. Hillary Vaughn of Fox News perfectly captured Mr. Cook’s embarrassment on Capitol Hill Thursday [Dec. 1, 2022] when she peppered him with questions:

“Do you support the Chinese people’s right to protest? Do you have any reaction to the factory workers that were beaten and detained for protesting Covid lockdowns? Do you regret restricting AirDrop access that protesters used to evade surveillance from the Chinese government? Do you think it’s problematic to do business with the Communist Chinese Party when they suppress human rights?”

A stone-faced Mr. Cook responded with silence.

CEOs can always justify their operations by pointing to the economic benefits their companies bring to the communities in which they operate. Or CEOs can go the progressive route, presenting their companies as moral paragons. But they can’t have it both ways: holding themselves up as courageous in places where the risk from speaking out is low while keeping quiet about real oppression in places where speaking out can really hurt the bottom line.

Open Is Good (Hearts, Minds, Societies, and Windows)

Windows are liberating. The person in the room can decide how much air and light to let in. So I have never liked when central planners who control buildings omitted windows that could be opened. Other things equal, let people choose. Florence Nightingale wanted open windows, partly based on the mistaken miasma theory of disease. John Snow famously and courageously showed that cholera was caused by bad water, not bad air, thereby jump-starting the process of experts rejecting the miasma theory. But although the miasma theory was not universally applicable (some bad things spread in ways other than the air) and was wrong in some details (what was bad about some of the air was not the air itself, but the pathogens in the air), some of the actions that had been taken on the basis of miasma theory had positive effects. Ventilation was good because the air did sometimes have something bad in it–bacteria and viruses. Closing up buildings kept the bad inside to spread and infect. So now, fortunately, we are back to recognizing that ventilation has important good effects. In the meantime less harm would have been done if our buildings and our other rules had allowed more individual liberty to choose (windows that could be opened), and less centrally planned mandates (windows sealed closed).

(p. D1) One of the paramount lessons of the Covid-19 pandemic is that fresh air matters. Although officials were initially reluctant to acknowledge that the coronavirus was airborne, it soon became clear that the virus spread easily through the air indoors. As the pandemic raged on, experts began urging building operators to crank up their ventilation systems and Americans to keep their windows open. The message: A well-ventilated building could be a bulwark (p. D5) against disease.

It was not a novel idea. More than a century ago, when infectious diseases ravaged cities in the United States and Europe, public health reformers preached the power of good ventilation, and open-air homes, hospitals and schools sprang up in New York, London and other locales on both sides of the Atlantic.

But over the last century, society lost hold of that idea. Scientific advances turned pathogens into problems that could be solved at the individual, biomedical level, with medicines and vaccines, rather than through infrastructure or societal change. Skylines became crowded with air-conditioned towers. An energy crisis encouraged engineers to seal structures tightly. And by the time the coronavirus arrived, Americans were spending their days in schools, offices and homes that could barely breathe.

Germ theory had not yet gained widespread acceptance; instead, the longstanding theory of miasma held that disease was the result of “bad air.” So sanitary reformers began calling for an overhaul of urban spaces, including improvements in ventilation. “An abundant supply of fresh air, at a proper temperature, is the first requisite of health in every place,” the Citizens’ Association of New York wrote in a report published in 1865.

Similar reforms were also underway in hospitals thanks, in part, to the crusading work of Florence Nightingale, the British nurse who was stationed at a filthy military hospital during the Crimean War in 1854. The nurse, who believed in the healing power of “air from without,” helped popularize pavilion-style hospitals, which featured long, narrow wards with a row of large, open windows running along each wall.

Ventilation rates fell and then plummeted further during the energy crisis of the 1970s, when buildings were sealed even more tightly. “In fact,” said James Lo, an architectural engineer at Drexel University, “a lot of effort pre-Covid is to try to reduce the amount of ventilation because people don’t want to spend the energy.”

In the United States today, the American Society of Heating, Refrigerating and Air-Conditioning Engineers, or ASHRAE, sets widely used indoor air quality standards and specifies minimum ventilation rates. In practice, these rates typically govern how buildings are designed, rather than how they are operated day to day, and many structures deliver less fresh air than they were designed to provide, experts said.

The standards define acceptable indoor air quality as air that does not have “harmful” levels of “known contaminants,” and with which at least 80 percent of occupants are satisfied. But infectious disease is not a focus.

“It says nothing about, ‘Does this level of air quality protect you from risk of infection when the seasonal flu is going around, or when there’s a novel epidemic disease, like Covid?’” said William Bahnfleth, an architectural engineer at Penn State University and the chairman of the epidemic task force at ASHRAE.

“Effective Altruism” Is Woke, Sanctimonious, Fraudulent, and Ineffective

(p. A1) Sam Bankman-Fried said he wanted to prevent nuclear war and stop future pandemics. And he publicly pledged to use his vast and growing wealth to do so.

But the collapse of Mr. Bankman-Fried’s firm, FTX, and the revelations that he mixed FTX’s money with that of its customers, have upended those declared lofty philanthropic goals.

Run by self-described idealists spending the wealth of their billionaire patron to make the world a better place, Mr. Bankman-Fried’s FTX Foundation and its flagship Future Fund touted deep pockets, ambitious goals and fast turnarounds.

Now Mr. Bankman-Fried’s fortune has disappeared, and the self-described philosopher-executives running the organizations have resigned. Grant recipients are scrambling for cash to plug the shortfall and fretting about the provenance of FTX’s largess after the company’s lawyers said this week that a “substantial amount” of assets were missing and possibly stolen.

(p. A6) Mr. Bankman-Fried often claimed philanthropy was his primary motivation for amassing a fortune. “It’s the thing that matters the most in the end,” he said in an April interview on the “80,000 Hours” podcast.

Mr. Bankman-Fried has said his law-professor parents instilled in him an interest in utilitarianism, the philosophy of trying to do the greatest good for the greatest number of people.

Will MacAskill, then a philosophy graduate student, pitched Mr. Bankman-Fried on the idea of effective altruism, a way of applying some utilitarian ideas to charitable giving.

Mr. Bankman-Fried had considered different career paths, he said in the “80,000 Hours” interview, but Mr. MacAskill suggested he could do the most good by making a lot of money and giving it away, a popular idea in the community.

Future Fund pledged hundreds of grants worth more than $160 million by September [2022], according to its website.  . . .

Its two largest public grants, of $15 million and $13.9 million, were awarded to effective altruism groups where Mr. MacAskill held roles. Mr. MacAskill, now a professor at Oxford University, wasn’t paid for his involvement in those organizations “other than expenses,” a spokeswoman for one of them said.

Mr. MacAskill distanced himself from FTX as it was crumbling. In a string of tweets, he accused Mr. Bankman-Fried of personal betrayal and abandoning the principles of effective altruism. He was also one of the Future Fund staffers who quit.

Last week, Mr. Bankman-Fried exchanged messages with a writer at Vox, a news organization that Building A Stronger Future had also pledged to fund.

“You were really good at talking about ethics,” she said.

“I had to be,” Mr. Bankman-Fried responded. He went on to explain it as “this dumb game we woke westerners play where we say all the right shiboleths [sic.] and so everyone likes us.”

In His Bathysphere Beebe “Maintained a Sense of Childlike Optimism”

(p. 28) Beautifully written and beautifully made, “The Bathysphere Book” is a piece of poetic nonfiction that strives to conjure up the crushing blackness of the midnight zone. Full color, overflowing with stunning illustrations of the uncanny creatures that live beyond the sun, it raises questions of exploration and wonder, of nature and humanity, and lets readers find answers on their own.

As he slipped deeper and deeper beneath the waves, Beebe bore witness to “a black so black it called his very existence into question,” and saw creatures that could be recorded only by describing them to Else Bostelmann, a painter who worked like a police sketch artist to render animals she would never see in colors like “bittersweet orange, metallic opaline green, orange rufous and orange chrome.”

B3) Researchers from the Natural History Museum London analyzed samples of bottom-dwelling animals collected on expeditions to the 2.3 million-square-mile area, known as the Clarion Clipperton Zone, which lies halfway between Hawaii and Mexico. Of the 5,578 species found in the zone, between 88% and 92% are new to science, according to the paper, published Thursday [May 24, 2024] in the journal Current Biology.

Adrian Glover, an author of the study and merit researcher at the museum, spent several months at sea collecting samples earlier this year.

“It doesn’t rival coral reefs or rainforests for diversity,” Glover said. “But it is actually higher than soft sediments along the continental shelf, which is just totally bizarre.”

Glover said new marine invertebrates are valuable because they can contain unusual chemical compounds that could potentially be turned into anticancer, antifungal or antiviral drugs.

Cars Give Commuters Flexible Choices Absent from Public Transit

In many cities, riders may need to go to the office only on Wednesdays. Or they want to pick up their children from school in the middle of the day or make a run to the grocery store.

Musk Says Productivity Rises When Firms Fire Employees Who “Slam the Brakes”

Builders of Untested Fragile R101 Airship Feared Revealing Danger to Head of British Air Ministry

The airships called “dirigibles” were sometimes also called “zeppelins” after their German inventor.

(p. 43) . . . zeppelins had fatal flaws. A single ignition source could turn one into a fireball, as British fighter pilots discovered once they started arming their planes with incendiary bullets. Explosive properties aside, dirigibles were all but uncontrollable in high winds and struggled to stay aloft when rain saturated their cloth skins, adding tons of extra weight.

That Britain persisted with its airship program owes much to the book’s main character, Lord Christopher Thomson, a retired brigadier and Labour Party politician who in 1923 was appointed to run the British Air Ministry. Witty, cultured and handsome, the India-born Thomson had a romantic vision of a “peaceful, air-linked world” that was closely tied to romance of a different sort. Thomson had for years been carrying on a long-distance affair with Marthe Bibesco, a ravishing (and married) Romanian princess and celebrated author. By 1930, during his second stint as air secretary, there was a chance he would be tapped as the next viceroy of India, a job that would take him even farther from his beloved. In Gwynne’s persuasive telling, Thomson believed that airships could save both the empire and his love life.

Thomson comes across as decent but hopelessly naïve, his faith in R101 based partly on bad information from the underlings responsible for building it. They knew the airship was too heavy, and that its gas bags — made from cow intestines — were prone to leakage. But with few exceptions they kept that knowledge to themselves, for fear of displeasing the boss.

It didn’t help that Thomson was on a tight schedule. Having claimed a berth on R101’s inaugural, round-trip voyage to India, he was determined to be back in London in time for a conference of colonial premiers, perhaps imagining a dramatic, Phileas Fogg-style entrance that would underscore the brilliance of his scheme. To accommodate him, flight tests were cut short, and the airship took off despite reports of bad weather along the route over France. There is reason to believe that the airship’s senior officer may have been drunk at the time.

The Role Disney “Fans Play in Creating the Disney Magic”

(p. 10) On Nov. 20, [2022],I was relieved to hear the news that Disney’s chief executive, Bob Chapek, had been fired and replaced with the former chief executive Robert Iger. The news was also met with near-unanimous celebration among my community of super fans.

While his ouster shocked investors and Hollywood, many in our community had been actively campaigning for Mr. Chapek’s firing for the past two years. A Change.org petition to fire Mr. Chapek that started in 2020 garnered over 117,000 signatures. (It now reads “Victory.”) Online forums teemed with complaints about Mr. Chapek’s management style and strategy.

We also pushed to have Mr. Chapek fired because he didn’t believe in Disney magic. Disney is so much more than just another big business. Understanding that is crucial to its success.

When Walt Disney opened Disneyland, he referred to his theme park customers as “guests,” an understanding that is explicitly reinforced in Disney employee training to this day, and by which Disney’s theme park community refers to itself.

What Mr. Chapek doesn’t understand is the role we fans play in creating the Disney magic. It is our Instagram accounts, our blogs and our websites that those out-of-towners refer to in order to prepare for that revenue-generating Disneyland trip. I get paid to do it, but many others do this work just because they love it. Mr. Chapek disregarded us.

Worse was the way Mr. Chapek treated “cast members,” as Disney’s park employees are known. The people who greet you at the park entrance, serve you food and get you safely on and off the rides have an enormous influence on the quality of your visit. I’ve talked to many cast members, from young people to older adults, about why they’re willing to wear polyester costumes in Florida’s summer heat for relatively low wages. To a person, they say something like, “I want to make people happy, and Disney is the best place to do that.”

So it was disheartening when, in September 2020, Mr. Chapek announced that the company was laying off 28,000 workers, most of them cast members. While many other businesses were laying off workers during that time, Mr. Chapek was also committing Disney to spending billions to ramp up content production for its Disney+ streaming service. As we saw it, Mr. Chapek viewed the incomes and health care of thousands of people — the people who make the magic — as less important than another season of “The Mandalorian.” Many cast members decided not to return to Disney’s parks when they reopened.

Much of Pandemic Funding to Improve Ventilation in Schools “Is Sitting Untouched in Most States”

(p. 1) As the next presidential election gathers steam, extended school closures and remote learning have become a centerpiece of the Republican argument that the pandemic was mishandled, the subject of repeated hearings in the House of Representatives and a barrage of academic papers on learning loss and mental health disorders among children.

But scientists who study viral transmission see another lesson in the pandemic school closures: Had the indoor air been cleaner (p. 16) and safer, they may have been avoidable. The coronavirus is an airborne threat, and the incidence of Covid was about 40 percent lower in schools that improved air quality, one study found.

The average American school building is about 50 years old. According to a 2020 analysis by the Government Accountability Office, about 41 percent of school districts needed to update or replace the heating, ventilation and air-conditioning systems in at least half of their schools, about 36,000 buildings in all.

There have never been more resources available for the task: nearly $200 billion, from an array of pandemic-related measures, including the American Rescue Plan Act. Another $350 billion was allotted to state and local governments, some of which could be used to improve ventilation in schools.

“It’s a once-in-a-generation opportunity to fix decades of neglect of our school building infrastructure,” said Joseph Allen, director of the Healthy Buildings program at the Harvard T.H. Chan School of Public Health.

Schoolchildren are heading back to classrooms by the tens of millions now, yet much of the funding for such improvements is sitting untouched in most states.

Among the reasons: a lack of clear federal guidance on cleaning indoor air, no senior administration official designated to oversee such a campaign, few experts to help the schools spend the funds wisely, supply chain delays for new equipment, and insufficient staff to maintain improvements that are made.

Some school officials simply may not know that the funds are available. “I cannot believe the amount of money that is still unspent,” Dr. Allen said. “It’s really frustrating.”
